By the 21 G. 3. c. 69. Every perfon who fhall Receiver of pew buy or receive any pewter pot or other veffel, or any ter, &c. pewter in any form or fhape whatever, knowing the fame to be ftolen or unlawfully come by; or fhall privately buy or receive any ftolen pewter, by fuffering any door, window, or shutter to be left open or unfaftened between fun-fetting and fun-rifing; or fhall buy or receive the fame in any clandeftine manner; he shall, although the principal felon has not been convicted, be transported not exceeding feven years, or detained in prifon and therein kept to hard labour not more than three years nor less than one; and within that time (if the court fhall think fitting), to be once or oftner, but not more than thrice, publickly whipped.

Finally, By the 22 G. 3. c. 58. Where any goods Buying or re (except lead, iron, copper, brafs, bell-metal, and folder) fhall ceiving stolen have been stolen, whether the offence amounts to grand larceny or fome greater offence, or to petty larceny only where the offender has been convicted of grand larceny or fome greater offence; every perfon who fhall buy or receive the fame, knowing them to have been ftolen, hall be guilty of a mifdemeanor, and punished by fine, imprisonment, or whipping, as the court of quarter feffions (who are hereby empowered to try him), or any other court before whom he fhall be tried, fhall think fit to inflict, although the principal be not convicted; and if the felony amounts to grand larceny, or fome greater offence, and the perfon actually committing fuch felony hath not been before convicted, fuch offender fhall be exempted from being punished as acceffary, if the principal fhall be afterwards convicted. f. 1.

And if any perfon being out of cuftody, or in cuftody if under 15 years of age, upon any charge of felony within the benefit of clergy, fhall have committed any felony, and afterwards difcover two or more who have bought or received any ftolen goods, fo as two or more be convicted, he shall have the king's pardon for all fuch felonies by him committed before fuch difcovery, which alfo fhall be a bar to an appeal. IX. Offering goods fufpected to be stolen, to be paruned or fold.

By the 30 G. 2. c. 24. If any perfon who fhall offer by way of pawn, pledge, exchange, or fale, any goods, fhall not be able, or fhall refufe to give a fatisfactory account of himself, or of the means by which he became poffeffed thereof; or if there fhall be any other reafon to fufpect that fuch goods are ftolen, or otherwife illegally or clandeftinely obtained, it fhall be lawful for any perfon, his fervants or agents, to whom the fame fhall be offered, to feize and detain fuch perfon and the faid goods, and to deliver him as foon as conveniently may be into the cuftody of the conftable or other peace officer, who fhall immediately convey fuch perfon and the faid goods before a juftice; and if fuch juftice fhall upon examination and inquiry have caufe to fufpect that the faid goods were ftolen, or illegally or clandeftinely obtained, he may commit him to fafe cuftody for any time not exceeding fix days in order to be further examined; and if upon either of the faid examinations it fhall appear to the fatisfaction of fuch justice, that the faid goods were ftolen, or illegally or clandeftinely obtained, he fhall commit the offender to the common gaol or house of correction, there to be dealt with according to law. S. 7.

Provided, that if fuch goods fo feized and detained as aforefaid shall afterwards appear to be the property of the person who offered the fame to be pawned, exchanged, or fold, or that he was authorized by the owner thereof to pawn, exchange, or fell the fame; yet nevertheless the perfon who fhall fo feize or detain the party who offered the faid goods, fhall be indemnified for having fo done. f. 8.

And by 22 G. 3. c. 58. Any perfon, to whom any goods reasonably fufpected to be ftolen, fhall be offered to be fold or pawned, may apprehend the perfon offering the fame, and carry him before a justice. f. 4.

X. Advertising or receiving a reward for helping to

By the 25 G. 2. c. 36. If any perfon fhall publickly advertise a reward, with no questions afked, for the return of things ftolen or loft, or fhall make ufe of words therein. purporting that fuch reward fhall be given, without feiz. ing or making enquiry after the perfon producing fuch thing; or fhall offer to return to any pawnbroker, or other, the money lent thereon, or other reward for the return thereof; he, and alfo the printer and publifher of fuch advertifement, fhall refpectively forfeit 50l. with cofts, to him who fhall fue in fix months.

And by the 4 G. c. 11. Wherever any perfon taketh money or other reward, directly or indirectly, under pretence, or upon account of helping any perfon to any stolen goods; he fhall (unless he apprehend the felon, or cause him to be apprehended, and brought to trial, and give evidence against him) be guilty of felony in the fame manner as if he had stolen the fame. f. 4.

XI. Charges of profecution and conviction how to be paid.

By the ftatutes of the 37. c. 10. and the 27 G. 2. c. Offenders to pay 3. The offender, if able, fhall pay his own charges for their own excarrying to gaol, and of thofe who guard him thither; and pences if able, if he is not able, then the treasurer fhall pay the fame out of the county rates; as is fhewn more at large in title Commitment.

By the 25 G. 2. c. 36. The court before whom Profecutor (if any perfon hath been convicted of any grand or petit lar-poor) to be at ceny or other felony, may at the prayer of the profecutor, and on confideration of his circumstances, order the county treasurer to pay him fuch fum as they fhall judge reafonable, not exceeding the expences he was put to in carrying on the profecution, with a reasonable allowance for his time and trouble: and the clerk of affize, or of the peace, fhall forthwith make out fuch order, and deliver the fame to the profecutor, on payment of 1 s. and the treafurer fhall pay the fame on fight, which shall be allowed in his accounts.

And by the 18 G. 3. c. 19. The court before whom any perfon hath been tried and convicted of any grand or petit larceny or other felony; or before whom any perfon bath been tried and acquitted of any grand or petit larceny or other felony, in cafe it fhall appear to the faid court that VOL. there was a reasonable ground of profecution, and that the profecutor had bona fide profecuted; may order the treasurer to pay to fuch profecutor fuch fum as they fhall think reafonable, not exceeding the expences he was bona fide put unto, making alfo (if he fhall appear to be in poor circumftances) a reasonable allowance for his trouble and loss of time; which order the clerk of afsize or clerk of the peace refpectively, fhall forthwith make out and deliver to him, on being paid for the fame I s. and no more; and the treafurer upon fight of the order fhall forthwith pay the fame. -And the juftices in feflions, from time to time, may lay down or alter fuch rules and regulations concerning any cofs or charges to be allowed to any person by virtue of this act: Which rules and regulations, having received the approbation and fignature of one or more of the judges of afize, fhall be binding, and not otherwife, on all perfons whatfoever.

By the aforefaid act of the 27 G. 2. c. 3. When any poor perfon fhall appear on his recognizance, in fuch case to give evidence, the court may allow him his reasonable charges, to be paid in like manner by the treasurer; the proper officer to have 6 d. for making out the order. Except in Middlefex, where the fame fhall be paid by the overfeers of the poor where the person was apprehended.

And by the 18 G. 3. c. 19. The court, where any person fhall appear on recognizance or fubpoena, to give evidence as to any grand or petit larceny or other felony, whether any bill of indictment be preferred or not, may order the treafurer to pay to him fuch fum as they fhall think reasonable, not exceeding the expences he was bona fide put unto, making alfo, if he fhall appear to be in poor circumstances, a reasonable allowance for his trouble and lofs of time; which order the clerk of affize or of the peace respectively fhall forthwith make out and deliver to him, on being paid for the fame 6 d. and no more; and the treasurer upon, ight of the order fhall forthwith pay the fame.
