to answer to all Matters and Circumftances relating thereunto, as by fuch Bill or Bills fhall be required; to which Bill or Bills, no Plea or Demurre shall be allowed, but the Defendant fhall answer the fame at large, upon Oath; which Anfwer fhall be good Ev.dence against the Defendant in Actions to be brought upon this Act, as in fuch Cafes are ufual; and that all Iffues to be try'd in any Action or Suit founded epon this Act, fhall be try'd by none but known Proteftants. And whereas by an Act of Parliament made in the Ninth Year of the Reign of his late Majefty, King William, of Glorious Memory, entituled,' Av A&t for Banishing all Papifts exercising any Ecclefiaftical Jurifdiction, and all Regulars of the Popish Clergy, out of this Kingdom, it is enacted, That all Popish Archbishops, Bishops, VicersGeneral, Deans, Jefuits, Monks, Fryers, and all other Regular Popish Clergy, and all Papifts exercifing Ecclefiaftical urifdi Etion, fhould depart out of this Kingdom before the First Day of May, which was in the Year of our Lord, One thoufand fix hundred ninety eight; and if any of the faid Ecclefiaftical Per fons should be at any time, after the faid First Day of May, within this Kingdom, they, and every of them, should fuffer Imprisonment, and remain in Prifon, without Bail or Mainprize, till he or they should be transported beyond Seas, out of her Majefy's Dominions, whither his then Majesty, his Heirs, or Succeffors, or the Chief Governor or Governors of this Kingdom, for the time being, should think fit.

And whereas it is further enacted by the faid Sta tute, That from and after the Nine and twentieth Day of December, which was in the Year of our Lord One thousand fix hundred ninety and feven, no Popish Arch-Rijhop, Bishop, Vicar-General, Dean, or any other Papift, Exercising any Ecclefiaftical Jurifdiction not Eftabifhed by the Laws of the Kingdom, Jefuit or Fryar, fhall come into the Kingdom from any Part beyond the Seas, on pain of Twelve Months Imprisone ment, and then to be Transported in manner aforefaid.

And whereas by one other A&t made in the Second Year of Her Majefty's Reign, Entituled, An Alt to prevent Popish Priests from coming into this Ringdom, It is Enacted, That every Clergyman of the Popish Religion that fhall come into this Kingdom at any time after the firft Day of January, in the Year of our Lord One thousand feven hun dred and three, fhall be, and is thereby declared to be liable to fuch Penalties, Forfeitures and Punishments, as by the faid Alt for Banifling all Papifts exercifing any Ecclefiafti cal Jurifdiction, and all Regulars of the popifh Clergy out of this Kingdom, is impofed on Popish Arch-Bishops, Bishops, Vicars-General, Deans, Jefuits, Friars, or any other Papifts exercising any Ecclefiaftical Jurisdiction, who sball come into this Kingdom contrary to the faid A&F.

And

And whereas by one other Act made in the faid Second Year of Her Majefty's Reign, Intituled, An At for Regiftring the Popish Clergy, it is Enacted, That all and every popish Priest or Priests who shall not make fuch Return, and enter into fuch Recognizance, as by the faid Statute is directed, and be thereof Convict at the Affixes or GeneralQuarter. Seffions of fuch County or Counties of Cities or Towns wherein he or they shall Dwell or be. Apprehended, shall feve rally be Committed to the Common-Goal of the respective Counties, Citics or Towns, where he or they fhall be fo Convict, there to remain without Bail or Mainprize, till he or they be Transported; and that all and every fuch Popish Priest or Priests, fo Convict as aforesaid, jhall be Trans ported out of this Kingdom in like manner as Popijh Regulars, and that all and every fuch Popish Priest or Priests, that hall neglect to Regifter him or themfelves, as by the faid Statute is directed, and shall remain in this Kingdom after the Twentieth Day of July, in the Year of our Lord One thou Sand feven hundred and four, fhall be efteemed a Popish Regular Clergy-man, and profecuted as fuch.

And whereas by one other A& made in the Sixth Year of Her Majefty's Reign, Intituled, An Act for the effectual preventing the taking away and marrying Children against the Wills of their Parents or Guardians, it is Enacted, That if any Popish Priests shall after the First Day of Novem ber, One thousand feven hundred and feven, prefume to cele brate the Marriage of any Perfon contrary to the true intent and meaning of the faid Statute, or shall celebrate Matrimony between any persons, knowing that at the time of fuch Mare riage, they or either of them is of the Proteftant Religion; every fuch Popish Priest So offending, and being thereof lawfully convicted, shall be deemed, adjudged and reputed to be a Popish Regular, and shall suffer the Pains, Penalties and Forfeitures of a Popish Regular. Notwithstanding which faid Statutes, feveral of the faid Popifh Arch-Bihops, Bishops, Vicars-General, Deans, Jefuits, Frys ars, Priefts convict, as aforefaid, and Papifts exercifing Ecclefiaftical Jurifdition, ftill remain in this Kingdom, and chufe to continue in Goal, rather than to procure themselves to be Tranfportd; where they do exercife their faid pretended Ecclefiaftical Jurifdiction; and officiate as Popish Priests, and may continue fo to do.

For Remedy whereof, Be it Enacted by the Autho rity aforefaid, That all and every Popish Arch-Bishop, Bishop, Vicar-General, Dean Jefuit, Fryar and Papift; exercifing Ecclefiaftical Jurifdiction, and every Popith Prieft, Popish School-mafter and Papifts, who by of fending against this or any former Act, are, or fhall be liable to Tranfportation, hall within Three Months

be Tranfmitted by Order of the Juftices of Affize, or by Order of the Juftices of the Peace, in their General Quarter-Seffions of the Peace, to the Common Goal of the next Sea-port Town, where he, they and every of them, fhall remain without Bail or Mainprize, until Tranfported.

And be it further Enacted by the Authority aforefaid, That it fhall and may be lawful to and for alf Mafters of Ships, Merchants and others, to take and receive the Body of fuch Popifh Regular Clergy-man, -fuch Popish Prieft and Popish School-mafter, fo new lying and remaining in Goal, and to be Tranfported, or who may hereafter remain in Goal to be Transported, and to Tranfport the faid Perfon or Perfons beyond the Seas, out of Her Majefty's Dominions of Great-Britain and Ireland. And if any Merchant freighting any Ship out-ward bound for any Place or Port not within either of the Kingdoms of Great-Britain or IreLand, fhall refufe to receive the Body or Bodies of fuch Popish Regular Clergy-man, or Popish Prieft, or Popish School-mafter, not exceeding Five, in any one Ship, when required fo to do by the chief Magiftrate, or his Deputy of fuch Place or Port where any fuch Popish perfon aforefaid fhall remain in Goal; the Colle&tor and Collectors, and other Officer of Her Majefty's Customs, are hereby required not to difcharge fuch Ship, until fuch Merchant fo freighting the fame, or fuch Master of a Ship fhall confent fo to do; on pain that fuch Colle&tor fo discharging fuch Ship, fhall forfeit to Her Majefty the Sum of Thirty Pounds Sterling.

And for an Encouragement to the faid Merchant or Mafter of a Ship to Receive and Transport the faid Perfon and Perfons, it fhall and may be lawful for the faid Collector of fuch Port or Place to pay, and they are hereby required to pay to the faid Merchant or Mafter of a Ship, the Sum of Five Pounds Sterling, for the Tranfportation of every fuch Perfon to any part of the West Indies, not being fubject to Her Majefty; and the Sum of Three Pounds Sterling for the Transportation of every fuch Perfon, to any Place or Port in Europe, not being within Her Majefty's Dominions; the fame to be allowed the faid Collector on his Accounts, on producing a Receipt of the faid Mer chant or Master of a Ship, acknowledging a Receipt of the faid Sum or Sums; and alfo a Receipt acknowledg ing that he hath received the Body of fuch Popifh Re gular Clergy-man, Popish Prieft or Popifh School mafter; in which Receipt fhall be expreft the Name of fuch Perfon fo to be Transported, and the place where the faid Perfon did last inhabit or refide, and the time

the faid Perfon hath remained in Goal, and from what County Goal he hath been transmitted to the faid Port or Place; which Receipts fhall be teftified by the chief Magiftrate, or his Deputy, of fuch Port or Place, and which Receipt herein laft mentioned fhall be Enrolled in the Crown Office of Her Majefty's Court of Chief Place in Dublin without Fee or Reward, there to remain of Record.

And be it further Enacted by the Authority aforefaid, That if any fuch Popifh Regular Clergy-man, Popish Prieft, or Popifh School-mafter, who fhall be found in this Kingdom out of the Cuftody of the faid Merchant or Mafter of a Ship fo receiving the faid Perfon, he fhall be deemed and taken to be, and shall füffer fuch Pains, Penalties and Forfeitures, as are inflicted on any Popish Regular Clergy-man, who hath been Banished and returned again into this Kingdom by the Laws and Statutes of this Realm; and the faid Merchant or Mafter of a Ship, fhall at the time of receiving the faid Sum or Sums from the Collector, and receiving the Body of fuch Popish Regular Clergy-mari Popish Priest or Popifh School-mafter, enter into a Recognizance to Her Majefty, Her Heirs and Succeffors, in the penalty of Fifty Pounds, to Transport the faid Popish Perfon into fome Place not within this Kingdom or the Kingdom of Great Britain, or the Dominions thereunto belonging; which Recognizance fhall be entred into by the faid Merchant or Master of a Ship, at the time of the Receipt of the refpective Sum or Sums of Five Pounds and Three Pounds, before the chief Magiftrate of the faid Town, Port and Place, and the Collector by whom the faid Sum fhall be paid, fhall produce and deliver the faid Recognizance to the Commiffioners of Her Majefty's Revenue; when he fhall Account for the payment of the faid Sum: Which Recognizance shall by the faid Commif fioners be returned into the Crown-Office of Her Majefty's Chief Place at Dublin, for which no Fee or Re ward fhall be paid.

And whereas by the Laws of this Land, Papifts are not qualified to keep any Horfe or Mare, or Gelding, of above 5. Value, which by Experience, is found prejudicial fo far forth as the fame relates to StudMares: For Remedy whereof, Be it Enacted by the Authority aforefaid, That no Stud-Mare kept for Breeding only, nor Stallion kept as fuch, and for no other ufe, fhall be deemed or taken to be within the intention of the A&t, Intituled, An Act for the better Securing the Government by Difarming Papifts, but that every Papist and reputed Papift may keep fuch Stud

Mares and Stallions, notwithstanding the said A& or any Law to the contrary, and the Breed and Produte thereof under the Age of Five Years, and not otherwife,

Provided, Nothing in this A&t fhall extend to the hindring the Lord-Lieutenant, or other chief Governors of this Kingdom for the time being, from feizing and fecuring any Horfe Mare or Gelding belonging to any Papift or reputed Papift, upon any Invafion likely to happen, or in any cafe of inteftine War broke out or likely to break out, any thing herein contained to the contrary notwithstanding.

And be it further Enacted by the Authority aforefaid, That in cafe the Lord Lieutenant, Lords-juftices, or chief Governor or Governors of this Kingdom, fhall fee, caufe or order any Horfe or Mare fo feized, to be delivered back to the Owner or Perfon from whom any Horfe or Mare was fo taken, that it fhall and may be lawful for every Perfon having or keeping fuch Horfe or Mare in his Cuftody, by vertue of the Authority aforefaid, to keep or detain the fame until the the Owner or Perfon from whom the fame was taken, fhall pay the Sum of 6 d. for every Night the faid Perfon did keep any fuch Horfe or Maie by vertue of the Authority aforefaid.

And be it further Enacted by the Authority aforefaid, That no Papift or Papifts who are or fhall be permitted to follow any Trade, Craft or Myftery in this Kingdom, fhall hereafter take or keep more than Two Apprentices at a time, in any fuch. Trade, Craft or Mystery (except the Hempen or Flaxen Manufacture). and that for no lefs a Term of Apprenticeship than Seven Years: And that whatever Papift fhall offend therein, by keeping more than Two Apprentices, or by taking or keeping Apprentices for a lefs Term than Seven Years, fuch Papifh fhall forfeit the Sum of 100%. for every fuch Offence, to be recovered by fuch Perfon who fhall Sue for the fame, in fuch manner as the feveral' Forfeitures exceeding the Sum of 10 l. herein before-mentioned are to be recovered.

Provided always, And be it further Enacted by the Authority aforefaid, That nothing in this A& contained, or in any other Act made in this Kingdom, fince the palling of an Act of Parliament in England, Intituled, An Act for the Relief of Colonel Henry Luttrel, with relation to the Ferfeited Eftates in Ireland; fhall prejudice, affect, defeat or take away any Eftate, Right, Title or Intereft in Law or. Equity, which the faid. Henry Luttrel, who is adjudged within the Articles of Limerick, had or hath, to, or in the Manor, Caftle,
