It fhould be obferved, that, abfcnce from church, alone, and unaccompanied by any other ac t, confiitutes reculancy, in the t1ue loufe of that word. Till the ftatutc of the 35 Eliz. Chap. 2. All nonconformifis were confidered as recu fants, and were all equally fubject to the pe nalties of rccufancy that ftatutc was the firft penal fiatute made againft p0pilh reeufants, by that name, and as (liltinguilhed fiom other 1eculants. From that ftatute a10fe the d'iftinélion between proteftant and popifli recufants; the former were fubject to fuch fiatutes of recul'ancy, as preceded that of the 35th of queen Elizabeth, and to fome ftatutes aghinft recufancy, made fubfequently to that time but they were relieved from them all.
