hold, occupy, enjoy, leave, receive, perceive, take, or recover the same, or any part, or parcel thereof, by reason or means of the said attainder and conviction of the said Sir Walter Ralegh: and yet upon this trust and confidence, and our express will, commandment, and pleasure is, that all and singular, the debts and duties which the said Sir Walter Ralegh did truly, and bona fide, owe to any person or persons, by bond or otherwise, before the said attainder and conviction, be justly and truly answered and paid to such person and persons to whom they be so justly and truly owing;

And farther know ye, that we, of our especial grace, certain knowledge, and mere motion, have given and granted, and by these presents, for us, our heirs, and successors, do give and grant, to the said John Shelbery and Robert Smyth, their executors, administrators, and assigns, for the better executing of this our grant at all and every time and times hereafter, and for the better getting and obtaining into their hands, all and every such things as hereby are unto them given and granted, full power and authority to enquire and find, or cause to be found and enquired of, by any office or inquisition, or by any other lawful ways, means, or device whatsoever, such right and title as we now have or ought to have, in or to the premises before by these presents granted, or any part or parcel thereof; and also to take, scize, levy, and recover by them the said John Shelbery and Robert Smyth, or by any other their ministers, deputies, or assigns, in any place or places whatsoever, the said goods and chattels, real and personal, and other the premises, before by these presents given and granted, and every part thereof, according to the due order and course of our laws, and they the said John Shelbery and Robert Smyth, their executors, administrators, and assigns, and every of them, shall have full power and authority, by virtue of these presents, at their wills and pleasures, to release, acquit, and discharge all and every person and persons whatsoever, their executors, administrators, and assigns, of the said goods, chattels, and other the premises before by these presents, given and granted, as is aforesaid, or any of them;

And also, that they the said John Shelbery and Robert Smyth, their executors, administrators, and assigns, in the name of them the said John Shelbery and Robert Smyth in their life-time, or in the names of their executors, administrators, or assigns, after their deaths, or otherwise, in our name, or in the names of any our heirs, or successors, shall and may suc for and recover the same goods and chattels, and other the premises,

by these presents granted, and every of them as is aforesaid, against any person or persons whatsoever, in any of our courts of record, at the will and pleasure of the said John Shelbery and Robert Smyth, their executors, administrators, or assigns, and every of them, and the same being recovered, levied, or received, to have, take, retain, and enjoy to their own use, uses, and behoofs; for which, these our letters patents shall be, as well unto the said John Shelbery and Robert Smyth, their executors, administrators, and assigns, as also to our officers to whom it shall appertain, a sufficient warrant and discharge in that behalf.

And our will and pleasure is, and by these presents we do straightly charge and command, you our said treasurer, chancellor, and barons of our exchequer, and all other our officers and ministers of the same court, that if it happen, at any time or times hereafter, any of the said goods, chattels, and other the premises whatsoever, granted by these presents unto the said John Shelbery and Robert Smyth, as aforesaid, or any part thereof to be recovered, seized, or paid unto us, our heirs, or successors; at the suits, or in the names of our heirs or successors; that then, and so often, you deliver, or cause to be delivered, the said goods, chattels, and other the premises, before by these presents granted, and every part and parcel thereof, so obtained, recovered and seized, or paid, to the said John Shelbery and Robert Smith, their executors, administrators, or assigns, to their own use, uses, and behoofs, and these our letters patents, or the in-, rolment thereof shall be unto you our said treasurer, chancellor, and barons of our said exchequer, and to all other our officers and ministers to whom it shall appertain, and to every of you and them, a full and sufficient warrant and discharge for the delivery, payment, and doing of all and singular the premises, according to the tenor, effect, and true meaning of this our grant.

And our farther will and pleasure is, and by these presents, for us, our heirs and successors, we do charge and command you, the said treasurer, chancellor, and barons of our said exchequer, and every of you, by virtue hereof, from time to time, to grant, and cause to be made forth of our said court of exchequer, such and so many commissions, and other lawful processes as shall be thought requisite by the said John Shelbery and Robert Smyth, their executors or assigns, for the lawful finding out, revealing, discovering, trial, recovering, or seizing, of all and singular the said goods, chattels, and other the premises, before by these presents, granted as aforesaid, and every part thereof; and this our letters patents shall be unto VOL. And to the intent that the said John Shelbery and Robert Smyth, their executors administrators and assigns, may fully and wholly enjoy all and singular the premises before by these presents given and granted, and every part and parcel thereof, according to our good and gracious meaning in that behalf, our will and pleasure is, and we do by these presents grant, for us, our heirs, and successors, to the said John Shelbery and Robert Smyth, their executors, administrators and assigns, that these our letters patents or the inrolment of the same, and every part, point, article and clause therein contained, shall be firm, good, effectual, and available in the law against us, our heirs, and successors, as well in all the courts of us, our heirs, and successors, as elsewhere within our realm of England, the not finding of any office or inquisition concerning the premises, whereby. our title thereto ought to be found before the making of these presents, or the not naming or not reciting of any person or persons, in whose hands, custody, or possession, the premises or any part thereof are remaining and being, or of the nature, kind, quantity, or quality of the premises, or any part thereof, or statute, act of parliament, law, ordinance, pro-clamation, provision, or restraint, or any other matter, cause, or thing whatsoever to the contrary, in anywise notwithstanding.

A Letter from SIR WALTER RALEGH, to Prince HENRY, touching the Model of a Ship.

"MOST EXCELLENT PRINCE,

"IF the ship Your Highness intends to build, be bigger

than the Victory, then her beams which are laid overthwart from side to side will not serve again, and many other of her timbers, and other stuff, will not serve; whereas if she be a size less, the timber of the old ship will serve well to the building of a new.

If she be bigger, she will be of less use, go very deep to water, and of mighty charge, our channels decaying every year, less nimble, less manageable, and seldom to be used. Grande navio grande fatica, saith the Spaniard.

A ship of six hundred tons will carry as good ordnance as a ship of twelve hundred tons, and where the greater hath double her ordnance, the less will turn her broadside twice before the great ship can wind once, and so no advantage in that overplus of guns. The lesser will go over clear, where the greater shall stick and perish; the lesser will come and go, leave or take, and is yare, whereas the greater is slow, unmanable, and ever full of encumber.

In a well conditioned ship, these things are chiefly required:

1. That she be strong built.

2. Swift in sail.

3. Stout-sided.
